In short

These terms apply when you book a trip, a shuttle or an airport concierge pickup with us, or use this website. They explain how bookings and payments work, what happens if plans change, and what each of us is responsible for. Nothing in them takes away the rights you have under South African consumer law.

About us and these terms

This website is operated by The Travel Maverick SA (PTY) LTD, registration number [company registration number] ("The Travel Maverick", "we" or "us").

  • Physical address: 64 Conrad Drive, Blairgowrie, Johannesburg, Gauteng, 2194, South Africa
  • Telephone: +27 78 673 3063
  • Email: travelmavericksa@gmail.com

We offer group trips and safari tours, shuttle services, and an airport concierge service. By making a booking or using this website you agree to these terms. If you do not agree, please do not book or use the website.

These terms are written to comply with the Consumer Protection Act 68 of 2008 ("CPA") and the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"). Our handling of your personal information is explained in our Privacy Policy, which forms part of these terms.

Bookings

  • Each trip has a fixed departure date and a limited number of places. Bookings are subject to availability. When a trip is full we show it as sold out and cannot accept further bookings for that departure.
  • When you submit a booking you make us an offer to book. A booking is accepted, and our agreement with you begins, when we confirm it (shown as "Confirmed" or sent to you by email). Until then it is "Pending".
  • Please give us accurate information. Traveller names must match the passport or identity document each person will travel with. You are responsible for any cost caused by incorrect details.
  • The person who makes the booking is responsible for everyone on it, confirms that they may accept these terms for the group, and must share these terms with each traveller.
  • If we cannot honour a booking, for example because of an error in availability or price, we will tell you as soon as we can and refund anything you have paid.

Prices and payment

  • Prices are in South African rand (ZAR) and are per person unless we say otherwise. Accommodation upgrades are priced per person and are shown before you pay. The total shown at checkout is the amount payable for that booking.
  • The trip description and your booking confirmation set out what is included. Anything not listed as included is for your own account, for example flights to the departure point, visas, travel insurance and personal spending.
  • Bookings are currently paid by electronic funds transfer (EFT), and we will tell you if other payment methods become available. Use your booking reference as the payment reference. Your places are held when you book, but the booking is only confirmed once we have received your payment.
  • Fees charged by your bank or payment provider are for your account.
  • Please read our Privacy Policy to see how the information you give us is handled.

Changes and cancellation by you

To change or cancel a booking, contact us in writing (email is fine) and quote your booking reference. A change or cancellation takes effect when we receive it.

Please note: cancellation charges

Under the CPA you may cancel an advance booking, but we may charge a reasonable cancellation fee. In deciding what is reasonable we take into account how much of the booking has already been performed or paid to third parties, whether we can resell the places, and what is usual in the travel industry. Our cancellation charges and refund timing are: [insert your cancellation fee schedule and how long refunds take].

  • Changes to dates or traveller names depend on availability and may carry a fee, which we will tell you about before you agree.
  • If a traveller does not arrive for a departure, shuttle or pickup, no refund is due unless the law requires one.
  • The seven-day cooling-off period in the ECTA does not apply to transport, accommodation and leisure services booked for a specific date or period, which covers our trips, shuttles and concierge pickups. Your cancellation rights are those set out in this section and in the CPA.

Changes and cancellation by us

  • We may change or cancel a trip, shuttle or pickup for reasons outside our reasonable control, such as safety, severe weather, government or travel advisories, supplier failure, or too few travellers to run the trip safely.
  • If we cancel, we will tell you as soon as reasonably possible and offer you either an alternative departure or a comparable trip, or a refund of what you paid for services we did not provide.
  • Times, routes and the order of activities may change for practical reasons. We will not make a significant change without telling you.
  • Neither of us is responsible for a failure to perform caused by events beyond our reasonable control (force majeure), but we will still refund amounts paid for services not provided.

Travel documents, health and insurance

  • You are responsible for having a valid passport, any visas or permits, and any required vaccinations for the countries you travel to. Requirements change, so please check with the relevant authorities before you travel.
  • Please tell us in advance about any medical condition, dietary need or disability that may affect your trip so that we can advise whether it is suitable and make reasonable arrangements.
  • We strongly recommend comprehensive travel insurance covering cancellation, medical costs and baggage.

Conduct and safety

Please note: risk

Safaris, outdoor activities and travel in other countries carry inherent risks, including risks from wildlife, terrain, weather, water, road travel and unfamiliar environments. By joining a trip you accept these ordinary risks. This does not limit our responsibility to take reasonable care, and it does not apply to loss or harm caused by our gross negligence or by anything else that the law does not allow us to exclude.

  • Please follow the instructions of your guide and driver, especially around wildlife, water and vehicles.
  • We may refuse to carry or host anyone whose behaviour endangers themselves or others, or who damages property. In that case the unused part of the booking is not refunded, unless the law requires it.

Shuttle services

  • A shuttle booking is for the route and date shown when you book. We confirm pickup details with you. Please give an accurate pickup address and contact number and be ready at the agreed time.
  • We plan for normal traffic and conditions, but journey times are estimates. We are not responsible for delays caused by traffic, road works, weather, border queues or other events outside our reasonable control, but we will do what is reasonable to get you to your destination.
  • Please tell us in advance about the number of passengers and the luggage you will bring so we can provide a suitable vehicle.

Airport concierge

Our airport concierge service collects your luggage at your door, helps you check in on your airline's app, and takes you and your bags to the airport's bag drop.

  • A pickup request on the website is not a confirmed booking. Your pickup is confirmed when we reply with your pickup time.
  • The "Plan your day" times on our website are a guide worked out from your flight time and drive time. They are not a guarantee that a bag drop or check-in will be open or accepted at that time.
  • We work around your airline's check-in and do not replace it. Your ticket, boarding pass, bag tags, baggage allowance, fees and security screening remain subject to your airline's and the airport's rules. Whether a bag is accepted is the airline's decision.
  • Our concierge will confirm your identity when they collect your luggage. You confirm that the luggage is yours or that you are authorised to travel with it, and that it contains nothing illegal, dangerous or prohibited.
  • Please keep your passport, boarding pass, other travel documents, money, medication and valuables with you and do not place them in luggage that you hand to us.

Our responsibility

  • We will provide our services with the care and skill you are entitled to expect, as the CPA requires.
  • Some services, such as flights, accommodation, activities and transfers in other countries, are provided by independent suppliers. We choose them with care, but they are separate businesses and their own terms may also apply.
Please note: limitation of liability

Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for gross negligence and your rights under the CPA. Subject to that, and to the extent the law allows, we are not liable for indirect or consequential loss, and our total liability for any claim arising from a booking is limited to the amount you paid us for that booking.

This website and your account

  • Please use the website lawfully. Do not try to access other people's accounts or bookings, interfere with the website, or use it to send us anything unlawful.
  • If you create an account, keep your login details private. You are responsible for activity on your account. We may suspend an account that is misused.
  • The text, logo and design of the website belong to us or our licensors. Please do not copy them without our written permission. Trip photographs are supplied by third parties and remain their property.
  • The website may link to or load content from third parties (for example fonts, icons and images). We are not responsible for their content or practices.
  • We try to keep the website accurate and available, but we do not guarantee that it will be free of errors or interruptions.
  • By using the website you agree that we may communicate with you electronically, and that electronic communications satisfy any requirement that they be in writing.

Complaints

If something goes wrong, please tell us first at travelmavericksa@gmail.com and quote your booking reference. We will acknowledge your complaint promptly and do our best to resolve it fairly. You are always free to approach the National Consumer Commission, or any other body or court with authority, if you are not satisfied.

Governing law

These terms and any dispute arising from them are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction.

Changes to these terms

We may update these terms from time to time. The date at the top of this page shows when they were last updated. A booking is governed by the terms that applied when you made it.
